Drunk drivers pose a considerable threat to anyone on the roadways. No one is immune to the potential danger of being involved in a car accident with someone who is under the influence of alcohol. If a person is killed in an accident due to the impairment of another driver, the family of the victim may want to consider filing a wrongful death claim against the driver deemed responsible.
Unfortunately, a fatal accident involving an allegedly drunk driver recently took place in Illinois. It was reported that a female driver along with a 4-year-old passenger were traveling south when they were hit in the rear by another vehicle. At this time, authorities believe the speeding and alcohol played a role in the accident taking place.
The female driver was taken to an area hospital, but she suffered fatal injuries in the crash. Her 4-year-old passenger was also transported from the scene with serious injuries, but it did not appear as if those injuries were life threatening. The male driver of the second vehicle reportedly suffered minor injuries. Furthermore, that driver was charged with aggravated DUI, and he was taken into custody after his release from the hospital.
Though the male driver is facing criminal charges for the accident, the family of the deceased woman may wish to consider a claim of their own. Because the situation resulted in a fatality, they may have cause to file a wrongful death claim. Should the driver of the other vehicle be convicted of the DUI charge, a case filed in Illinois on behalf of the decedent may have a great chance of success.
